- How To Enter. In order to participate in the Credit Program for Surcharges, participants must sign up via web [surgesucks.com] and send an email receipt(s) from Uber or Lyft in which participant personally paid a surge or peak time fee (collectively, a “Surcharge”) during the Program Period (defined below) for a ride that started and ended in New York City (i.e., anywhere in any of the following counties in New York State: New York, Queens, Kings, Bronx and Richmond). Participants must sign up (Step 1) and forward receipts (Step 2) using the same email address. The complete and unaltered email receipt (the “Entry”) must clearly display: (i) the identity of the company issuing the receipt, (ii) the date and time of the ride, (iii) the amount of the Surcharge in US dollars, and (iv) the pick-up and drop-off locations. All Entries must be submitted by participant by no later than the conclusion of the Program Period. Each receipt shall be submitted only once by a participant, although participants may submit multiple unique Entries during the Program Period. Gett reserves the right to: (i) reject any Entry that does not strictly comply with these requirements; and (ii) verify and/or reject the accuracy of any information provided in an Entry, including the right to seek additional information regarding the Entry from participant. Failure of the participant to provide additional information reasonably requested by Gett may result in rejection of participant’s Entry.
- Credit Program for Surcharges. Subject to the limitations in this agreement, Gett will provide participants whose Entries are approved with a credit to be used solely in connection with booking rides via the Gett mobile app or website, in an amount equal or higher to the amount of the Surcharge in the Entry, up to a maximum of US $50 (fifty dollars) per participant. Participants who entered before 02/01/16 can receive up to a maximum of US $100 in Gett credit in their lifetime for all eligible Surcharge receipts submitted through the Gett Surge Sucks Surcharge Programs. Participants who entered on or after 02/01/16 can receive up to a maximum of US $50 in Gett credit in their lifetime for all eligible Surcharge receipts submitted through the Gett Surge Sucks Surcharge Programs. The credit is non-transferable. All credits will be given by way of a coupon code to the participant and will expire on the Credit Expiration Date (defined below). In the event two or more participants submit the same receipt, credit will be given to the participant who first submitted their Entry. Gett reserves the right to terminate or suspend the Credit Program for Surcharges in the event total credit offered by Gett during the Program Period equals or exceeds [US $25,000]. Receipts from rides dated after the day a participant signs up date will not be accepted.
- Surcharge Contest. All approved Entries for the Credit Program for Surcharges will be automatically entered in the Surcharge Contest. After conclusion of the Program Period, Gett shall award a prize of US $1,000 in Gett ride credit (the “Prize”) to the participant whose Entry shows the highest Surcharge paid during the Program Period. The Prize is non-transferable and is to be used solely in connection with booking rides via the Gett mobile app or website. The Prize will be given by way of a coupon code to the Prize winner and will expire on the Credit Expiration Date (defined below). Gett shall notify the Prize winner via the e-mail address provided in the Entry by no later than the Prize Notification Deadline (defined below). In the event two or more participants entered the same winning receipt, the Prize shall be awarded to the participant who first submitted their Entry. In the event of a tie for the highest Surcharge among participants who entered different receipts, Gett, in its sole discretion, shall either: (i) award the Prize to the participant who first submitted their Entry, (ii) pro-rate the Prize among the winning participants, (iii) award multiple Prizes, or (iv) distribute the Prize in another manner that Gett deems fair and equitable. Receipts from rides dated after the day a participant signs up date will not be accepted.
- Prize Conditions: The Prize shall be added directly to the winner’s Gett account or shared as a coupon code by email in Gett’s sole discretion. Payment of all taxes in connection with the prize shall be the sole responsibility of winner. The Prize must be claimed within thirty (30) days of first attempted notification or will be forfeited. The Prize will expire two years after the winner’s first notification. The Prize is non-transferable and the winner has no right of substitution.
- Eligibility. Participant eligibility is limited to natural persons, at least twenty-one (21) years of age, who have downloaded the Gett app on their mobile device. The Credit Program for Surcharges and/or the Surcharge Contest (collectively, the “Promotion”) are void where prohibited or restricted by law and is subject to all applicable federal, state and local laws and regulations. Employees (and their immediate families and household members) of Gett, its corporate parent, affiliates, subsidiaries, advertising and promotion agencies are not eligible to participate in the Promotion or any aspect thereof.
- Conditions of Participation. Participants agree to be bound by these rules and all decisions of Gett, whose decisions will be final. All Entries become the property of Gett and will not be acknowledged or returned. Gett shall not be responsible for registration errors or for lost, late or misdirected mail (including e-mail), or telecommunication or computer hardware or software failures. Gett reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion, or any portion hereof, or to disqualify any individual implicated in any of the following actions: (i) tampering, unauthorized intervention actions by participants, fraud, technical failures, or any other causes which, in Gett’s sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion , or (ii) the Promotion is otherwise not capable of running as planned
- Opt-In. By submitting an Entry, participant hereby agrees that Gett may use participant’s name, e-mail address, phone number, and other personally identifiable information provided by participant in any manner consistent with the terms and conditions of Gett’s privacy policy, which may be updated from time to time.
- Indemnity and Waiver of Liability. By submitting an Entry, participants agree to release, discharge, indemnify and hold harmless Gett and their parent, subsidiaries, affiliates, divisions, advertising and promotional agencies, wholesalers and retailers, contractors, sub-contractors, and each of the foregoing entities’ employees, officers, directors, shareholders and agents (collectively the “Released Parties“), from and against any and all claims, costs, actions and/or liability for any injuries or death, loss or damage of any kind to person(s) or property (including, without limitation, violation of any personal rights, such as violation of right of publicity/privacy, libel, or slander) arising from or in connection with participation in and/or entry into the Promotion or acceptance, delivery, or use of any prize, including without limitation, the Prize. The Released Parties are not responsible or liable for any incomplete, incorrect or inaccurate Entry information, and assume no responsibility for (i) typographical or other errors in the printing of the promotion materials or the offering or announcement of the prizes; (ii) any error, printing error, omission, interruption, defect or delay in operation or transmission at any website; (iii) failure of any Entry to be received by Gett due to technical problems, printing error, or human error, (iv) communications line, hardware and/or software failures; (vi) theft or destruction of, tampering with, unauthorized access to, or alteration of Entries and/or Entry information; or (vi) any Entries which are incomplete, late, lost, stolen, damaged, delayed, misdirected, mutilated, illegible, received with postage due, unintelligible, or any combination thereof. By submitting an Entry, participants agree to comply with these Rules. Any participant who attempts to tamper with the Promotion or any aspect thereof in any way shall be disqualified. Additional restrictions may apply.
- Publicity Release/Winner Obligations. By submitting an Entry, participant agrees that: (a) Gett may use participant’s name, photograph, likeness and/or image on Gett’s websites or for any other marketing or advertising purpose without notice, compensation, credit or right of review or approval. Acceptance of a prize or credit from Gett constitutes that person’s consent to have Gett use, publish, reproduce and for all purposes, including publicity, promotion and advertising, in any media now known or hereafter discovered (including online and offline), winner’s name, city, photograph, likeness, voice, image, surge fee amount, peak time fee amount, in perpetuity without further notice, compensation, credit or right of review or approval; and (b) The Prize winner shall participate at Gett’s expense in reasonable advertising and promotional activities as selected by Gett, including without limitation interviews (video or otherwise), photos, blog posts, and other written, photo or video submissions as may be reasonably requested by Gett from time to time. All such advertising and promotional activity and content in which winner participates, and all rights therein, shall be owned exclusively by Gett, which shall have full editorial control over same.
- Choice of Law/Forum. The Promotion and its rules shall be governed by and construed in accordance with the laws of the State of New York without regard to choice or conflict of law provisions. All participants agree that all disputes arising out of this Agreement shall be heard exclusively in the federal and state courts located in New York County, New York, and courts with appellate jurisdiction therefrom. Participants agree to submit to the personal jurisdiction of such courts, and further agree that venue in New York County is both proper and convenient.
- Definitions.
- “Credit Expiration Date” means 11:59 pm Eastern Time on [11/30/2016]
- “Gett” means GT Forge, Inc d/b/a Gett, 237 West 35th Street, New York, New York 10001, and shall include its corporate parent, subsidiaries, affiliates companies, and the officers, directors, shareholders, employees, agents and representatives thereof.
- “Prize Notification Deadline” means 11:59 pm Eastern Time [11/03/2016].
- “Program Period” means the time period between 12:01 am Eastern Time on [10/1/2016] and 11:59 pm Eastern Time on [10/31/2016].
